The Supreme Court (SC) issued a writ habeas corpus to former National People's Army (NPA) Leader Rodolfo Salas, recently arrested for murder in Angeles City.
The notice said in the SC's third division filed the writ of habeas corpus and ordered Manila City warden to present the former NPA leader on March 12.
Earlier, Salas was arrested on February 18 for murder as he was alleged to be part of the Communist Party of the Philippines Central Committee—the group who allegedly ordered the execution of their political enemies in the 1980's.
The Police claimed they seized a gun and ammunition from Salas.
Salas' son, Jody, argued his father can no longer be charged with murder due to his 1991 conviction for rebellion which was based on a plea bargain deal that shields him from further prosecution.
Salas is now detained at Camp Bagong Diwa located in Bicutan, Taguig City.
